How Much Does it Cost to File an Application and Register a Trademark?

The cost to register a trademark depends on several factors, including the type of trademark you are seeking to register, the number of Classes to which the mark applies, and whether you are filing the application electronically or on paper.

On average, the government filing fee to file an electronic trademark application through the United States Patent and Trademark Office's (USPTO) online system, called the TEAS system, ranges from $225 to $400 per class of goods or services. For filing a paper application, the cost is generally around $400 per class.

In addition to the government filing fee, there may also be other costs associated with the trademark registration process, such as legal fees (domestic and/or foreign law firm service fees), the cost of a trademark search, the cost of reviewing and processing the application, and other costs if any complications arise during the process.

It is also worth noting that the cost of registering a trademark may vary depending on the country in which you are seeking protection.

Examples of Trademark Filing Costs by Country

  1. The average cost to file a trademark application in the United States would be approximately $1,550* per class of goods or services.
  2. The average cost to file a trademark application in Japan would be approximately $870* per class of goods or services.
  3. The average cost to file a trademark application in China would be approximately $600* per class of goods or services.

*All three of the above-estimated costs do not include the cost of a basic trademark search and further do not necessarily guarantee a successful registration.

Keep in mind that these are just a few examples, and the total cost of registering a trademark can vary significantly depending on the law firm service fees and the specific circumstances of your application.

Price Breakdown of Trademark Registration

Although trademark registration may seem overwhelming at first glance, understanding the step-by-step process of registering makes it easier to understand the flow as well as the price breakdown. The process is mainly divided into three steps (in chronological order): application, office action (OA), and registration.

The price breakdown varies according to these steps with one exception: OA only occurs when there are any legal problems associated with your trademark and/or application. The costs for all three steps are inclusive of government filing fees and legal fees (including both domestic and foreign law firm service fees).

However, keep in mind that there are online services like MARQ Folio that offer trademark filing and registration in a cost-effective way in which only foreign law firm service fees are incurred while domestic law firm service fees are not. Moreover, note that registration costs are generally lower than application costs and OA rates differ across countries as well as the individual pricing of law firms.

Tips to Consider When Filing Your Trademark Application

  • File your application online: Many countries offer an online filing option that can be less expensive than filing by paper.
  • Consider online registration services: There are many online services that provide trademark filing and registration in a simple, cost-effective way, such as MARQ Folio: a worldwide trademark filing service where you can get help from top-tier local law firms, submit an application within a few minutes, and check and manage the process of all your applications through a dashboard.
  • Consider filing a "trademark application by an individual": In some countries, individuals may be eligible for reduced fees when filing a trademark application.
  • File a national application rather than an international application: If you are seeking protection in a single country, you may be able to save money by filing a national application rather than an international application.

While these options may help to reduce the cost of registering a trademark, some may also require more time and effort on your part, and may not be suitable for everyone. It is always a good idea to carefully consider your options and choose the approach that best meets your needs.
